Promotion of Access to Information Act (No. 2 of 2000)

1. Introduction

The Promotion of Access to Information Act (PAIA) grants a requester access to records of a private body, if the record is required for the exercise or protection of any rights.

This manual informs requesters of procedural requirements for access to the records of Jyaras Jewellers (Pty) Ltd t/a J-Exchange. It also includes information on the processing of personal information as required by the Protection of Personal Information Act (POPIA).

4. Records Available Without Request

The following records are automatically available to the public and do not require a formal PAIA request:

  • News and marketing information on the company website.
  • Brochures, newsletters, and indicative price lists.
  • Corporate governance documents explicitly made public (e.g., Privacy Policy, Terms of Service).

5. Records Available in Accordance with Legislation

Records are kept in accordance with the following legislation (where applicable):

  • Annual Financial Statements
  • Tax Returns and VAT records
  • Asset Registers & Banking Records

C. Operational Records

  • Sellers: ID copies and transaction logs (SAPS Mandated).
  • Corporate: SLAs, NDAs, Certificates of Destruction.
  • Logistics: Waybills and Chain-of-Custody docs.

7. Processing of Personal Information (POPIA)

7.1 Purpose of Processing

We process data to comply with the Second-Hand Goods Act, execute contracts, manage employees, and ensure site security.

7.2 Security Measures

We employ "Gold Standard" security including biometric access control, digital encryption, and 24/7 CCTV surveillance.

7.3 Transborder Flows

The Company may store data on secure cloud servers (e.g., Microsoft 365, Offsite Backups) hosted outside South Africa. We ensure any third-party operator adheres to data protection laws substantially similar to POPIA.

8. Request Procedure

  1. The Form: Complete Form 02: Request for Access to Record (Available from the Information Regulator).
  2. Submission: Submit the form to the Information Officer via email.
  3. Fees: A request fee may be payable as prescribed by law.
  4. Timeline: We will respond within 30 days.

9. Remedies for Refusal

Internal Remedies: The Company does not have an internal appeal procedure. The decision of the Information Officer is final.

External Remedies: If dissatisfied, you may apply to the Information Regulator or a court with appropriate jurisdiction for relief within 180 days.
